This Unit examines the individual employment relationship under the contract of employment and the rights and duties that arise under contract and from the National employment Standards in the Fair Work Act 2009 (Cth). You will study the principles, rights and remedies in termination of employment, including protection from unfair dismissal and other general protections under the Fair Work Act 2009 (Cth), as well as statutory protection from discrimination at work. You will examine the legal distinction between employment and other work arrangements and the implications for workers and employers of the distinction.

Learning outcomes
- Identify and critically examine the contract of employment and be able to compare it to other forms of worker/labour arrangements at law.
- Identify and critically examine rights and obligations arising under statute & the common law relating to employees and other workers more generally.
- Research and apply the relevant laws to problem solving scenarios.
- Critically evaluate the efficacy of the law of employment and other forms of worker arrangements at law and convincingly state the need for changes to the law.
- Contribute to individual and collaborative knowledge building, with a clear sense of how these observations may be adapted to future learning through reflective practice which is driven by honesty and clear purpose.
Workload
Minimum total expected workload to achieve the learning outcomes for this unit is 144 hours per semester typically comprising a mixture of scheduled learning activities and independent study. The unit requires on average three/four hours of scheduled activities per week. Scheduled activities may include a combination of teacher directed learning, peer directed learning and online engagement.
