Overview

This unit provides comprehensive coverage of the theory and skills of Principled Negotiation, and their applications in mediation and related forms of dispute resolution. You will: • explore a coherent and systematic framework for understanding negotiation, and its implications for participants in mediation and related processes; • practise using guidelines for getting best results in negotiation, and for improving the effectiveness of mediation and related processes; • practise techniques for defusing conflict in negotiation and mediation; • identify key factors that define the various ADR processes available, and apply them in choosing an appropriate process for disputes; and • examine practical and ethical tensions commonly faced in negotiation and dispute resolution processes.

Learning outcomes

  1. Apply knowledge and understanding of the theory of principled negotiation, and practical guidelines for improving negotiation and dispute resolution processes, with creativity and initiative to new situations.
  2. Analyse, synthesise and evaluate information to effectively prepare for and participate in negotiation and dispute resolution.
  3. Demonstrate advanced communication skills and advanced process management strategies in negotiation and dispute resolution.
  4. Analyse, synthesise and evaluate information to advise clients regarding choice and/or tailoring of dispute resolution processes.
