Overview

This unit explores an area of the law where far-reaching effects of globalisation have produced considerable consequences: technology regulation. These legal developments are driven at global level by institutions that make policy and regulation, and have also witnessed the evolution of existing institutions and rules. You will study the most pressing policy choices faced by governments, institutions and stakeholders, and how those policy choices are translated into the law, in particular with regard to the advanced machine learning techniques popularly known as Artificial Intelligence (AI). In relation to information law, the module focuses on the institutions that regulate and police new technologies. You will also analyse the problems of access to these technologies, and how current regulation affects choices of law and regulation. The teaching focus is on the international nature of the subject matter – offering a highly comparative analysis of current legal developments around the globe.

Learning outcomes

  1. Demonstrate high-level understanding in relation to intersecting and competing theories of cyberlaw, and critically assess their implications in the new technological age.
  2. Critically analyse the distinct role of cyberlaw in a range of legal contexts and frameworks, as it affects the use of Artificial intelligence in both Australian and international legal contexts.
  3. Identify, research and synthesise information from a range of sources in order to make informed commentary on the legal and legislative mechanisms in place for implementing cyberlaw in Australian and international contexts.
  4. Formulate convincing evaluations and judgement on the recent expansion of cyber law and/or its interaction with other laws in both Australian and international contexts.
  5. Work collaboratively to investigate and persuasively present findings on legal problems related to the Artificial Intelligence, regulation and cyberlaw.

Workload

Minimum total expected workload to achieve the learning outcomes for this unit typically comprises of a mixture of scheduled learning activities and independent study applicable to a 6 credit point unit. Learning activities may include a combination of teacher directed learning, peer directed learning, and online engagement.
