If you’ve been reported for general misconduct and are required to attend a general misconduct hearing, you’ll usually be told of the outcome of the hearing on the day.

If you’re found to have engaged in misconduct, you may receive one or more penalties.

Types of penalties

Consent penalties for misconduct (see 43(1) of the Monash University (Council) Regulations) include:

  • an apology
  • a written reflective piece about the misconduct.

The penalties available under regulation 42(2) of the Monash University (Council) Regulations include:

  • a reprimand
  • a suspension
  • exclusion from the University.

If you're found not to have engaged in misconduct, no further action may be taken.

Appeals

Under some circumstances, you have 20 days to appeal the decision to an independent party. For details, see appeal a general misconduct decision.

Information you provide at an interview or panel hearing must be held by Monash for at least seven years. In some circumstances, this material may be provided to external agencies, such as a criminal court. If you're concerned about this, you should speak to a lawyer before the interview.

You can access free legal advice by contacting Victoria Legal Aid or the South-East Monash Legal Service.
