Overview

This unit is drawn on the existing and emerging legal and regulatory aspects governing banking and financial sector. You will be introduced to a range of legal issues covering traditional banking, financial advice and sale of financial products, consumer credit, securities and lending, electronic payments, fintech and anti-money laundering and counter terrorism financing. This unit will be of interest if you wish to develop a deeper understanding of regulatory aspects in banking and finance sector.

Learning outcomes

  1. analyse the legal and regulatory foundations of Australia’s banking and finance sector incorporating ASIC’s product intervention power, design and distribution obligations and financial accountability regime
  2. evaluate how key principles governing the financial advice framework are implemented to ensure compliance and ethical standards in financial advisory services
  3. assess legal compliance in consumer credit activities under the National Consumer Credit Protection Act (NCCPA)
  4. evaluate the statutory obligations of the reporting entities under the Anti-Money Laundering and Counter-Terrorism Financing (AML/CTF) regime in Australia
  5. investigate legal and regulatory challenges related to electronic banking, cybersecurity, financial technology, and sustainable finance aligned with the United Nations Sustainable Development Goals (UN SDGs).

Workload

Minimum total expected workload to achieve the learning outcomes for this unit is 144 hours per semester typically comprising a mixture of scheduled learning activities and independent study. Independent study may include associated readings, assessment and preparation for scheduled activities. You are expected to complete all pre-class activities prior to your scheduled class, and post-class activities should be completed after your scheduled class. Learning activities may include a combination of teacher directed, peer directed and online engagement activities.
