Overview
This unit will explore contract law principles and issues from a comparative and international perspective. This unit will compare, contrast and critically evaluate contract law from the perspective of different legal systems and international instruments such as the UNIDROIT Principles of International Commercial Contracts and the United Nations Convention on Contracts for the International Sale of Goods. The unit will involve a comparative study of selected issues in contract law such as unfair contract terms, good faith, third-party rights and sustainability in global supply chains. These issues will be evaluated with regard to the underlying themes and policy considerations of contract law; such as protection against unconscionability, freedom of contract and principles of fairness and good faith.

Learning outcomes
- Demonstrate an advanced and integrated understanding of selected complex contract law issues from the perspective of comparative and international contract law.
- Apply advanced legal reasoning to generate appropriate jurisprudential and practical responses to complex legal issues in a range of contexts.
- Engage in high-level critical analysis and make compelling, reasoned and appropriate choices amongst alternatives, and demonstrate sophisticated cognitive and creative skills in approaching legal issues and generating appropriate responses.
- Demonstrate the intellectual and practical skills needed to justify and interpret theoretical propositions, legal methodologies, conclusions and professional decisions as well as to identify, evaluate and synthesise relevant factual, legal and policy issues.
- Communicate in ways that are effective, appropriate and persuasive to a range of audiences, and collaborative effectively.
Workload
