Overview

The unit introduces you to the law and practice of the sale of land in Victoria. You will develop an understanding of the legal principles governing the creation, structure and finalisation of contracts of sale of land and the transfer of land in practice. You will analyse and gain an understanding of how sale of land is regulated from both the seller’s and buyer’s perspective. This will be followed by an examination of the general conditions of standard contract of sale of land to develop an understanding of the circumstances when these general conditions require to be either supplemented or amended by special conditions to manage relevant risk. The unit includes an examination of the main land related taxes and duties and also introduces you to the electronic settlement regime. Overall, the unit provides you with practical, applied knowledge of sale of land transactions equipping you with skills directly relevant to legal practice in property and commercial law.

Learning outcomes

  1. Identify facts that give rise to legal issues in the context of the sale of land.
  2. Critically assess policies and principles, including regulatory strategies, to promote fair and efficient sale of land transactions.
  3. Provide practical, considered and commercially relevant legal advice in relation to a range of legal issues related to the sale of land.
  4. Apply intellectual and practical skills to interpret, synthesise and apply legislative provisions and case law relating to the sale of land.
  5. Communicate in ways that are effective, appropriate and persuasive.
  6. Evaluate the role of law in regulating and facilitating the sale of land.

Workload

Minimum total expected workload to achieve the learning outcomes for this unit is 144 hours per semester typically comprising a mixture of scheduled learning activities and independent study. The unit requires on average three/four hours of scheduled activities per week. Scheduled activities may include a combination of teacher directed learning, peer directed learning and online engagement.
